1. ELIGIBILITY

You must be 18 years or older, and legally capable of entering into a binding contract, to place an order on this website. By ordering, you confirm that this is the case.

2. RESTRICTED & REGULATED ITEMS

Some products sold on this website — including plate carriers, body armour components, and other tactical equipment — may be subject to purchase restrictions, permits, or other requirements under South African law. It is the customer's sole responsibility to ensure that their purchase, possession, and use of any product complies with all applicable national, provincial, and local laws.

Noctis Africa reserves the right to request proof of eligibility, refuse an order, or cancel a sale at our discretion where we reasonably believe a purchase may not comply with applicable law. We accept no liability for a customer's failure to comply with laws governing the products they purchase.

3. PRODUCTS, PRICING & AVAILABILITY

All prices are listed in South African Rand (ZAR) and include VAT unless otherwise stated. We make reasonable efforts to ensure product descriptions, images, and specifications are accurate, but we do not warrant that all content is error-free.

Products are subject to availability. If an item you've ordered is unavailable, we will contact you to offer a substitute, refund, or delay, in line with the Consumer Protection Act.

4. ORDERS & PAYMENT

By placing an order, you're making an offer to purchase, which we may accept or decline. A contract is only formed once we confirm your order.

Payment is processed securely through our payment gateway. We do not store your full card details.

5. SHIPPING & DELIVERY

We deliver nationwide across South Africa using reputable third-party couriers. Delivery timeframes and costs are calculated at checkout based on your location and the items ordered. While we work with our courier partners to deliver within the estimated timeframe shown at checkout, delivery dates are estimates and not guaranteed.

6. RETURNS & REFUNDS

Returns and refunds are handled in accordance with our Return and Refund Policy, which forms part of these Terms.

7. INTELLECTUAL PROPERTY

All content on this website — including text, images, logos, and the Noctis Africa Expert Insight content — is the property of Dark Earth Tactical (Pty) Ltd or its licensors, and may not be copied or reused without permission.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Noctis Africa's liability for any claim arising from your use of this website or purchase of products is limited to the value of the relevant order. Nothing in these terms limits any right you have under the Consumer Protection Act that cannot lawfully be excluded.

9. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.

10. CHANGES TO THESE TERMS
